DRAIN AND SEWER

Sewer lateral compliance certificates: EBMUD's triggers, tests and dates.

In much of the East Bay of California a house sale needs a sewer lateral certificate, or a time extension, before the title transfers. The test is witnessed, the deadline is the sale, and the certificate lasts seven years or twenty depending on what was done to the pipe.

TAKEAWAY

Know the trigger, book the witnessed test early, and record which certificate you got.

The East Bay Municipal Utility District's Regional Private Sewer Lateral Ordinance requires a compliance certificate when a property is sold, when permitted construction or remodeling costs more than one hundred thousand dollars, and when the water meter is resized. The certificate is issued after the lateral passes an air or water test witnessed by EBMUD. It lasts twenty years when every lateral on the parcel was replaced or lined along its full length, and seven years otherwise. An assistant can carry the deadlines; the test result and the ownership questions stay with people.

This article sets out the program as published on 15 October 2026 and then shows how to track it. It is not legal advice: the property owner and the contractor confirm the current rules with EBMUD and the city before relying on them.

01 / WHERE IT APPLIES

Six sewer service areas, and one city with its own program.

The ordinance, in its consolidated text effective 24 May 2019, applies only within the sewer service areas of Alameda, Albany, Emeryville, Oakland and Piedmont and of the Stege Sanitary District. EBMUD's contractor guidelines add that Stege serves Kensington, El Cerrito and the Richmond Annex, and that Berkeley runs its own program (all as checked on 15 October 2026). A company working across the area keeps the parcel's service area on every job, because a Berkeley job follows a different rule set.

02 / THE TRIGGERS

Three events require a certificate, and each sets its own deadline.

EBMUD's program page and section 6 of the ordinance list the same three triggers; section 6 also requires one wherever a local agency's own ordinance expressly does. An owner can also ask for a certificate voluntarily at any time.

EBMUD's three triggers and the deadline each sets (as checked on 15 October 2026)
TriggerDeadlineWho obtains the certificate
Sale or other title transferBefore the transfer completes, a certificate or a time extension certificate (EBMUD's page says the certificate is required to close escrow); missing both is a violation, though the ordinance says the transfer itself stays legalThe seller or the buyer, as they agree between them; once the transfer is complete, the buyer alone
Construction or remodeling costing more than one hundred thousand dollarsBefore the final permit or approvalThe property owner
A larger or smaller water meterBefore EBMUD works on the meterThe property owner

The ordinance also carries exceptions that change a job's paperwork: exemption certificates, common interest developments, and parcels with more than a thousand feet of private lateral. Some transfers, such as to a spouse or child or into a living trust, are not title transfers under the ordinance; a short-term exemption certificate documents that. A tracker records which exception applies; it does not decide.

03 / THE WITNESSED TEST

Air or water, with EBMUD's inspector watching.

The ordinance defines the verification test as one witnessed by EBMUD's authorized representative, and the certificate follows when that representative finds every lateral on the parcel compliant. The ordinance lets EBMUD waive the test only where it cannot physically be done, and a local agency's waiver can take the lower lateral out of it. EBMUD's contractor guidelines, dated August 2019, give the method. A water test passes when a five-foot standpipe shows no observable loss after five minutes; a low-pressure air test passes when the pressure falls by no more than one psi in five minutes from a starting pressure of at least 3.5 psi. The lateral must be connected to the main for the set-up to count, and in Alameda and Albany only the upper lateral is tested.

The same guidelines add practical detail. A building or sewer permit from the local agency is needed before repair or replacement work, and in Emeryville even when the lateral is tested as it stands. The contractor must be ready at the start of the inspection window or rebook and pay a rescheduling fee. And where digging is needed, contractors are directed to USA North 811 at least two working days beforehand, with a warning that private laterals are not usually marked and that a gas line bored through a lateral can go undetected. Acting on that warning is the crew's job; an assistant only makes sure it sits on the job sheet.

04 / SEVEN YEARS OR TWENTY

What was done to the pipe decides how long the certificate lasts.

Section 8 of the ordinance gives a certificate obtained through replacement of all the parcel's laterals a life of twenty years from issue, and every other certificate seven years, with exceptions for waivers, common interest developments and large parcel groups. Replacement means replacing or lining the complete length of the lateral; a repair corrects less than the whole length. A lateral that passes as it stands, or after a spot repair, therefore receives the shorter certificate.

That distinction belongs on every option sheet in the area, written as the ordinance writes it and never as a sales argument. It belongs on the tracker too: certificate type, issue date and expiry date, copied from the certificate itself. A seven-year certificate obtained for one sale can lapse before the next one.

05 / WHEN THE SALE COMES FIRST

A time extension certificate runs 180 days from its issue, and only once.

If a certificate cannot be obtained before the title transfer, the ordinance allows a time extension certificate, issued for title transfers only. It expires 180 days after issue, needs a refundable deposit and any fee EBMUD sets, cannot be renewed, and the deposit may be forfeited if no compliance certificate is obtained in time. EBMUD's program page states the same 180 days. Whether to use one is for the seller, the buyer and their agents to decide; the tracker only shows the date it lapses.

06 / ONE ROW PER PARCEL

One row per parcel, counted down from the closing date.

Sale-triggered lateral work is a deadline list. In Aevrion's design the owner creates a Bot in Grok Bot, here called Permits, which works on a persistent cloud computer. A weekly routine on it reads the company's job list (through a tested custom integration, or a sheet in the Bots' shared workspace) and the closing dates the owner enters, drafts a status line for each open parcel, and says plainly when a source could not be read instead of reusing last week's line. The row's stages are an Aevrion pattern, not a Grok Bot feature.

07 / THE AGENCY SITE

Checking the agency's site is supervised browser work, and it will change.

The Grok Bot documentation says Bots can work with many browser-based tools, that a site can block automation or require a human step, and that the Bot should hand logins, codes and payments to a person rather than get around them. Whether EBMUD's property search works for a Bot is something to test, not assume. EBMUD's page also announces a move to a new platform for scheduling, payments and certification, expected in 2026, so a routine that reads the site has to be checked again whenever it changes; the reliable workflows article covers that kind of routine design.

Buyer sewer scopes outside EBMUD's area use the same row with a different end: a coded inspection report delivered by the date the buyer's agent sets, with no agency test involved. NASSCO's page for its BSDI program says it encourages jurisdictions to require BSDI in point-of-sale and lateral inspection ordinances, so the owner checks what the city in question actually requires (as checked on 15 October 2026).

08 / ENGLAND AND WALES

In England and Wales the boundary decides who is responsible.

England and Wales raise a different question for a drainage contractor: who is responsible for the pipe. Since 1 October 2011, sewers shared by more than one property, and lateral drains that serve one property but lie outside its curtilage, have been the responsibility of the water and sewerage company where they drained to a public sewer as at 1 July 2011, while a drain serving one property within its own curtilage stays with the owner. Pipes draining to a septic tank or private treatment works stayed private. The Welsh Government's guidance on the transfer notes that the law gives no exact definition of curtilage, so its extent may have to be settled case by case (both as checked on 15 October 2026).

The assistant can file the CCTV drain survey, the position of each defect relative to the boundary as the surveyor recorded it, and the water company's contact details. It never tells a customer, in Oakland or in Cardiff, who is responsible for a section of pipe. That statement comes from the owner, the water company or the agency.

09 / THE OPEN-JOB LIST

List every open sale-triggered job and its closing date.

List every open job with a lateral trigger, its closing or permit deadline, the stage it has reached and who holds it. The jobs without a booked test are the ones at risk. The tracker, the routine and the boundaries around them are what Aevrion Ops would scope with an owner, including supervised browser use of agency sites where those sites allow it and once tested. A scoping conversation through the contact page is the first step.

SUMMARY

What to take from this.

  1. EBMUD's regional ordinance requires a lateral compliance certificate at sale, for permitted work over one hundred thousand dollars, and for a water meter size change.
  2. The certificate follows an air or water test witnessed by EBMUD, and lasts twenty years after full-length replacement or lining of every lateral, seven otherwise.
  3. A time extension certificate, for title transfers only, expires 180 days after it is issued and cannot be renewed.
  4. A routine can track closing dates, test bookings and certificate expiry; the test result, payments and ownership statements stay with people.
