PAINTING
Painting pre-1978 homes: RRP pamphlet timing, signed receipts and records.
A painter cannot do the job without disturbing paint, so on a house built before 1978 the lead-safe file is part of the work, not an extra. The rule sets the dates and the contents of that file. An assistant can keep it moving; the credentialed renovator answers for it.
TAKEAWAY
On older homes the RRP file belongs to nearly every painting job.
Scraping, sanding and preparing old paint is what painters are paid for, and in housing built before 1978 that work falls under EPA's Renovation, Repair and Painting rule. For a painting contractor that means five things: the firm certification EPA requires, a renovator holding EPA's renovator credential assigned to the job, the Renovate Right pamphlet delivered inside a set window with proof of receipt, lead-safe containment and cleaning on site, and a file that shows all of it, kept for three years.
An AI assistant can track that file: flag the house's age, count the pamphlet window against the current start date, list what the file is missing and draft the post-job notice. It does not make a job lead-safe and it does not decide what the rule requires in a given state. The credentialed renovator and the firm answer for compliance; this is the federal rule as published, not legal advice.
01 / WHO THE RULE COVERS
Every paid firm, including a painter working alone.
As checked on 15 October 2026, EPA's RRP program page says that anyone paid to perform work that disturbs painted surfaces in homes, childcare facilities and preschools built before 1978 must hold EPA's firm certification, and that employees must be trained in lead-safe work practices, either by training as renovators themselves or on the job from a renovator who holds the credential. The page is explicit that this includes all firms, even sole proprietorships. A one-person painting business needs the firm certification as well as the individual credential.
The same page lists the states, and one tribe, that EPA has authorized to run their own RRP programs; the owner confirms which applies. And RRP work and lead abatement are separate programs with different certifications. A repaint that disturbs old paint is RRP work, not abatement.
02 / WHAT PAINTER PREP TRIGGERS
Exterior scraping and interior repaint prep leave different evidence in the file.
EPA's page notes that worn lead-based paint on friction surfaces such as doors and window sills can produce chips and dust, which describes exactly the surfaces a repaint crew sands. Under 40 CFR 745.86 (as checked on 15 October 2026), the records must include the assigned renovator's statement of how the work area was contained and cleaned, and the containment steps differ between an interior repaint and an exterior one. Under 40 CFR 745.85 the rule also prohibits some prep methods outright, among them open-flame burning or torching and machine sanding or planing without a shroud and HEPA vacuum attachment, and limits heat guns to below one thousand one hundred degrees Fahrenheit; the renovator chooses the methods.
The file can also take a different route. If a renovator holding the credential tested the components with an EPA-recognized test kit and found no lead-based paint, the records keep that determination instead: the kit's manufacturer and model, the components tested and where, and each result.
| Item | Interior repaint | Exterior repaint |
|---|---|---|
| Objects | Removed from the work area or covered | Not listed for exteriors |
| Openings | Windows in the work area closed; doors closed and sealed; HVAC ducts closed and covered | Windows and doors in and within twenty feet of the work area closed, and doors sealed |
| Surface covering | Floor covered with taped-down plastic sheeting six feet beyond the surfaces being worked, or further if needed to contain the dust | Ground covered with disposable impermeable sheeting anchored to the building, ten feet beyond the surfaces or further to collect falling debris, unless the property line prevents it |
| Further containment | Doors in the work area that stay in use for passage covered to stop dust spreading | The same for doors in use, plus vertical containment where needed to keep dust and debris off neighboring property |
| Clean-up | Chips and debris picked up; sheeting misted, folded dirty side in and taped; surfaces cleaned with a HEPA vacuum or wet cloths or mops; waste contained | Chips and debris picked up; sheeting misted, folded dirty side in and taped; waste contained on site and in transport |
| Final check | Cleaning verification performed by the renovator, with the results briefly described | Cleaning verification performed by the renovator, with the results briefly described |
03 / THE PAMPHLET WINDOW
No more than sixty days before work, with a signed acknowledgment, or a certificate of mailing at least seven days before.
The timing is in 40 CFR 745.84 (as checked on 15 October 2026). No more than sixty days before renovation begins in a dwelling, the firm gives the owner the pamphlet and either obtains the owner's written acknowledgment of receipt or obtains a certificate of mailing at least seven days before the work. Where the owner does not live in the unit, an adult occupant also receives the pamphlet. If no adult occupant will sign, the firm may instead certify in writing that the pamphlet was delivered, recording the address, the date and method of delivery, who delivered it, why there is no acknowledgment, and a signature and date from the firm.
The acknowledgment itself has required contents: the owner's or occupant's name, a statement that they received the pamphlet before the work started, the address, their signature and the date. It can be a separate sheet or part of the contract, and it is written in the same language as the contract (or, for a rented unit, as the lease or the pamphlet). Because the rule lets it sit inside the contract, a painter can build it into the proposal packet so it is signed with the job.
EPA's Renovate Right page offers the pamphlet in English and Spanish (September 2011 revision, with an insert for April 2010 printings), as checked on 15 October 2026; the tracker records which version went out.
04 / AFTER THE JOB
The file closes with a notice to the owner and three years of retention.
Under 40 CFR 745.86, when the final invoice is delivered or within thirty days of completing the renovation, whichever comes first, the firm gives the building owner, and an adult occupant if different, the information showing how the job complied. EPA's Sample Renovation Recordkeeping Checklist, or a similar form, may be used. The records demonstrating compliance are then kept for three years after completion and made available to EPA on request; the rule says that period does not override any longer state or tribal retention requirement (all as checked on 15 October 2026).
For a painting company the practical consequence is that the RRP notice belongs with the invoice. An invoice sent while the renovator's checklist is still in a crew lead's truck has already missed that deadline.
05 / ONE PRE-1978 JOB
One pre-1978 job, from the estimate sheet to the end of retention.
The tracker below is Aevrion's pattern for a Bot in Grok Bot, working on a persistent cloud computer. A routine on that Bot runs each weekday morning, a schedule the documentation supports, and whenever a start date changes the owner asks it to recheck that job. It opens every open pre-1978 job, recalculates the pamphlet window against the current start date, and lists each missing item. The routine is told what to do when a job file cannot be read: report it and stop, not work from an old copy. Signed acknowledgments can be attached as photos, and the tracker is a spreadsheet the owner can review. The job files live in the company's own system; the documentation says a Bot's memory is no substitute for an authoritative source. Reaching job software is a custom integration, built and tested against what the vendor allows.

06 / THE RENOVATOR'S JOB
The assistant tracks the paperwork. The renovator answers for the job.
Nothing in this design makes a company compliant. Containment, cleaning and the cleaning verification happen on site under the renovator who holds the credential, and the firm answers for them. A person sends the notice to the owner; the morning routine only drafts, because an approval nobody answers lapses after about ten minutes (Cursor's help pages say thirty).
Two practical cautions. Every Bot on the account shares one cloud computer, its files and browser sign-ins included, and separate Bots are not a security boundary, so signed acknowledgments saved there are readable by every Bot on the account. And this article covers painting; window replacement raises RRP questions of its own, which the window replacement guide in this series takes up. Aevrion Ops can help a painting contractor set up the tracker, the morning routine and the integration to their job software where the vendor's API or terms allow it, after testing. The readiness assessment is the place to start.
SUMMARY
What to take from this.
- EPA's RRP rule covers anyone paid to disturb paint in pre-1978 housing, and the firm certification applies to every firm, sole proprietorships included.
- The pamphlet goes out no more than sixty days before work, with either the owner's signed acknowledgment of receipt or a certificate of mailing obtained at least seven days before work starts.
- Exterior and interior repaints need different containment, and the renovator's records describe which was used.
- Compliance information goes to the owner with the final invoice or within thirty days of completion, whichever is earlier.
- Records are kept for three years after completion unless a longer state or tribal rule applies.
- An assistant tracks dates and missing items; the renovator who holds EPA's credential and the firm are responsible for compliance.
